Piggs Peake Winery Priceless Experience - Terms and Conditions

1. This experience is exclusively for Mastercard cardholders 18 years of age or over who are registered members of Priceless.com and have replied, by the RSVP Deadline specified in the offer (if applicable), while inventory is available.
2. By booking, each person attending the experience ("Guest"), including cardholders who have booked for themselves and/or for other person(s) acknowledge and accept the terms and conditions set forth for this experience.
3. If the Guest(s) have met the eligibility requirements and receive an available spot(s) for this experience, Mastercard will email the primary guest who has booked the experience, a confirmation of purchase and Mastercard may contact you within 3 working days of purchase to provide further details. Please reach out to priceless.anz@mastercard.com with any questions. Inquiries must be in English language.
4. Offer is non-refundable and subject to applicable taxes. No returns, exchanges, substitutions or cash redemptions permitted unless otherwise stated in these terms.
5. Mastercard is not responsible for any Guest(s) transportation to or from the venue.
6. A government-issued valid ID is required for admittance. Admission is subject to the restrictions and requirements of the seller, merchant, venue and event organizers, as applicable. You may be required to complete a waiver and/or release prior to participation in the experience.
7. Experience is for personal use only, is non-transferable, and may not be resold, (re)streamed, republished or used by Guest(s) for any commercial or promotional purpose whatsoever. Any resale or attempt to resell, restream or republish the experience by Guest(s) is strictly prohibited and will be a breach of these terms and, in addition to any other rights or remedies available to us, may result in Guest experience and/or Guest(s) Priceless account registration being cancelled without prior notice or liability to you.
8. Mastercard does not control responses provided by any third-party host or presenter of an experience, and statements made by any such parties, including without limitation, brand ambassadors and celebrities, may not reflect the views of Mastercard. In addition, Mastercard does not endorse and is not making any recommendation regarding any products, services or other material that may be presented or described by any such third party during the experience.
9. Alcoholic beverages will be made available for Guests during this experience. Guest(s) must be of legal drinking age to consume alcohol and proof of age may be required. Guest(s) assumes full responsibility for their actions and well-being. Mastercard urges its Guests to drink responsibly.
10. Mastercard and the experience organizer(s) reserve the right to refuse to serve intoxicated Guest(s) alcohol and/or ask the intoxicated Guest(s) to leave the premises. Mastercard and the organisers are not liable for any incidents or injuries resulting from excessive alcohol consumption.
11. Mastercard reserves the right to disqualify Guest(s) from participating in this and any future experience if Guest's behaviour, including any communication via email or any other communication channel, is deemed inappropriate, harmful, harassing, illegal, offensive or for any other reason is deemed to be inconsistent with any applicable terms of use or other policies of any applicable platforms or providers, in Mastercard's absolute and final discretion. If a Guest's participation is denied for any of the reasons set forth in this provision, Mastercard will, time permitting, attempt to confirm the next qualifying cardholder. The rights in this provision are in addition to any other rights or remedies available to us and may also result in cancellation of Guest's Priceless account registration.
12. Guest participation in this experience constitutes Guest's consent for Mastercard, its affiliates and third parties on behalf thereof to use and publish Guest's image and/or voice as captured by any audio or video recording, as well as Guest's name, avatar, biographical data, questions or any additional information that is provided by you in connection with this experience without any limitations of time, place or content for Mastercard's promotional purposes, without compensation, except as required by law.
13. Each Guest agrees that such Guest's personal data, such as: first name, surname, email address and phone number, are only processed for the purposes of participating in the experience, notifying the purchaser(s) and delivering the experience.
14. Mastercard reserves the right at any time to cancel, modify, reschedule or change this experience or any aspect of it, if Mastercard determines, in its sole discretion, that the experience is not capable of being conducted as specified or is not advisable under the circumstances. This will apply in any of, but is not limited to, the following circumstances: force majeure events, fraud, technical failures, or any other causes beyond the control of Mastercard or experience provider. If the experience is cancelled, any amounts already paid by Guest(s) will be fully reimbursed or the experience will be rescheduled, at Mastercard's discretion.
15. By participating, Guest(s) agree that Mastercard, experience provider and their designees and assigns and each of their respective officers, directors, employees, shareholders, representatives and agents shall have no liability and will be held harmless for any liability, loss, injury or death to Guest(s) including, without limitation, damage to personal or real property, due in whole or in part, directly or indirectly, by reason of the acceptance, possession, use or participation in this experience.
16. These terms may be changed, varied, modified and/or deleted by Mastercard in its sole and absolute discretion at any time and from time to time without any prior notice to any person and by participating in the experience each Guest irrevocably and unconditionally accepts any such changes, variations, modifications and deletions.
17. By redeeming this experience, each Guest acknowledges and consents to the processing of such Guest's personal data for the purposes of this experience in accordance with the https://www.priceless.com/privacy/en_AU.
18. By participating, each Guest further agrees to be bound by these terms & conditions and the Priceless® Terms of Use, which can be found at: https://www.priceless.com/terms/en_AU.
19. Any question concerning the legal interpretation of these terms will be based on the laws of New South Wales, Australia and the courts of New South Wales, Australia will have exclusive jurisdiction.
20. If any of the provisions of these terms becomes or is invalid, illegal or unenforceable in any respect under applicable law, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired and such invalid, illegal or unenforceable provisions shall be deemed severed from these terms and Mastercard shall be entitled to replace such severed provisions with such other provisions as it may deem fit.
21. These terms prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. In the event of any inconsistency between the English language version of these terms and any other language version, the English language version shall prevail.
